Terms Of Service

1.Introduction
a. This Terms of Service Agreement (“Agreement”) governs your access to and use of the CAPSJ website (the “Website“) and its associated services (collectively, the “Services“). By accessing or using the Services, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to all of the terms and conditions of this Agreement, you are not authorized to use the Services.
2.User Accounts
a. You may be required to create an account (“Account“) to access certain features of the Website. You are responsible for maintaining the confidentiality of your Account information, including your username and password. You are also responsible for all activities that occur under your Account. You agree to notify CAPSJ immediately of any unauthorized use of your Account or any other security breach. CAPSJ shall not be liable for any loss or damage arising from your failure to comply with these security obligations.
3.Content
a. The Website and Services contain content owned or licensed by CAPSJ, including but not limited to text, graphics, logos, images, software, and other materials (“Content“). The Content is protected by copyright, trademark, and other intellectual property laws. You agree not to use, modify, reproduce, distribute, or create derivative works of the Content without the express written consent of CAPSJ.
4.User Submissions
a. Please read this carefully. In order for an Article to be distributed as widely as possible on an Open Access basis in the Cannabis And Psychedelic Science Journal (the Journal) you grant Cannabis And Science Psychedelic Journal an exclusive license to publish this Article including the abstract in printed and electronic form, in all languages. This will enable the Journal to provide the benefits of Open Access publishing while preserving the integrity and archival status of all published articles. The Article is deemed to include all material submitted for publication and includes the text, figures, tables, author contact details and all supplementary material accompanying the Article. As author, you remain the copyright owner of the Article, unless copyright is owned by your employer. (US Federal Government authors please note: your Article is in the public domain.)
b. Your Article will not be published unless you agree to the terms outlined in this Exclusive License Form as part of the manuscript submission process.
c.Open access: You require that the Article be published on an Open Access basis. This means that the full text of the Article can be accessed by readers without paying the publisher.
d.Please note: You retain the following rights to re-use the Article, as long as you do not sell or reproduce the Article or any part of it for commercial purposes (i.e. for monetary gain on your own account or on that of a third party, or for indirect financial gain by a commercial entity). This does not affect your rights to receive a royalty or other payment for works of scholarship. These rights apply without needing to seek permission from the Journal.
e.Prior to acceptance: We ask that as part of the publishing process you acknowledge that the Article has been submitted to the Journal. You will not prejudice acceptance if you use the unpublished Article, in form and content as submitted for publication in the Journal, in the following ways:
i. sharing print or electronic copies of the Article with colleagues;
ii. posting an electronic version of the Article on your own personal website, on your employer’s website/repository and on free public servers in your subject area.
f.After acceptance: Provided that you give appropriate acknowledgement to the Journal, and full bibliographic reference for the Article when it is published, you may use the published version of the Article in the following ways:
i. you may share print or electronic copies of the Article with colleagues;
ii. you may use all or part of the Article and abstract in personal compilations or other scholarly publications of your own work (and may receive a royalty or other payment for such work); or you may use the Article within your employee’s institution or company for educational or research purposes, including use in course packs;
iii. You may post the final PDF of the Article on your own personal website, on your employer’s website/repository and on free public servers in your subject area.
iv. Electronic versions of the accepted Article must include the following statement, adapted as necessary for your Article:
g. Author Posting. © The Authors {Insert year of publication} This is the author’s version of the work. For full bibliographic citation, please refer to {insert journal name}, {insert volume, issue number and pages}.
h. Third parties will be entitled to re-use the Article, in whole or in part, in accordance with the conditions outlined in the Creative Commons Deed, Attribution 2.5 Non-Commercial, No Derivatives (further details from www.creativecommons.org), which allows Open Access dissemination of your work, but does not permit commercial exploitation or the creation of derivative works. i. In agreeing to the terms of this Agreement:
i. You hereby warrant that this Article is an original work, has not been published before and is not being considered for publication elsewhere in its final form either in printed or electronic form;
ii. You hereby warrant that you have obtained permission from the copyright holder to reproduce in the Article (in all media including print and electronic form) material not owned by you, and that you have acknowledged the source;
iii. You hereby warrant that this Article contains no violation of any existing copyright or other third party right or any material of an obscene, indecent, libelous or otherwise unlawful nature and that to the best of your knowledge this Article does not infringe the rights of others;
iv. You hereby warrant that in the case of a multi-authored Article you have obtained, in writing, authorization to enter into this Agreement on their behalf and that all co-authors have read and agreed to the terms of this Agreement;
v. You warrant that any formula or dosage given is accurate and will not if properly followed injure any person;
vi. You will indemnify and keep indemnified the Editors and the Journal against all claims and expenses (including legal costs and expenses) arising from any breach of this warranty and the other warranties on your behalf in this Agreement.
5.Fees and Payments
a. CAPSJ may charge fees for certain Services, such as manuscript review and publication fees. All fees are non-refundable except as provided in CAPSJ’s Refund Policy (see [link to Refund Policy]). You agree to pay all fees associated with your use of the Services in accordance with the fee schedule displayed on the Website.
6.Disclaimer of Warranties
a. THE SERVICES ARE PROVIDED “AS IS“ AND “AS AVAILABLE“ WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CAPSJ MAKES NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.
7.Limitation of Liability
a. IN NO EVENT SHALL CAPSJ BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF CAPSJ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
.Termination
a. CAPSJ may terminate your access to the Services at any time, with or without cause, upon written notice to you. You may terminate your Account at any time.
.Governing Law and Dispute Resolution
a. This Agreement shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of laws provisions. Any dispute arising out of or relating to this Agreement shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be held in New Orleans, Louisiana.
.Entire Agreement
a. This Agreement constitutes the entire agreement between you and CAPSJ regarding your use of the Services and supersedes all prior or contemporaneous communications and proposals, whether oral or written.
.Amendments
a. CAPSJ may amend this Agreement at any time by posting the amended terms on the Website. You are responsible for periodically reviewing the amended terms. Your continued use of the Services after the amended terms are posted constitutes your agreement to be bound by the amended terms.
.Severability
a. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
.Waiver
a. No waiver of any provision of this Agreement by CAPSJ shall be deemed a further or continuing waiver of such provision or any other provision.
